环境民事责任的构成要件是指行为人因违反环境法定义务实施环境不法行为致人损害而应承担民事法律责任所必需的各种要件的有机统一。它包含如下内容： 1、损害后果。环境民事责任作为不法行为人对于环境权益受侵害的被侵权人所承担的财产责任，其前提和基础就是不法行为人的排污行为对被侵权人造成了损害后果。有损害则有补偿，无损害则无补偿是民事责任的基础，不同于环境刑事责任和环境行政责任是为了追究行为人具有社会危害性的违法行为的法律责任，因而不以违法行为造成损害后果为法律责任的构成要件。损害后果只是违法行为人承担环境行政责任和环境刑事责任轻重的选择要件。 2、排污行为。排污行为作为特定经济技术条件下，在生产和生活过程中不可避免的行为，其本身具有一定的价值性，它是单位和个人在促进经济发展和生活消费的过程，在现有经济技术条件下尚无可或缺的附属行为。但环境侵权行为作为一种特殊侵权行为，环境民事责任作为一种无过错责任，只要行为人所实施的排污行为造成他人环境权益的损害均应承担环境民事责任，而不以其主观上具有过错或客观上实施的排污行为违法为要件。盖因环境容量的有限性与生产与生活过程中产生的排污量的数量与浓度的扩张不成比例，这既是排污者实施排污行为致人损害应承担环境民事责任的基础，也是国家环境管理政策由浓度控制向总量控制转变的原因。 3、排污行为与损害后果之间具有因果关系。排污者的排污行为与被侵权人所受到的损害后果之间具有因果关系，既是行为人具有可归责任性因而应当承担环境民事责任的基础，也是被侵权人具备损害赔偿请求权的资格并可向排污者提出环境损害赔偿请求的基础。唯环境损害的因果关系因其复杂性、专业性、科学技术性难以确定，故在最高人民*关于民事诉讼证据的若干规定的司法解释中明确规定：因环境污染引起的损害赔偿诉讼，由加害人就法律规定的免责事由及其行为与损害结果之间不存在因果关系承担举证责任。之所以在环境污染损害赔偿案件中采取举证责任倒置的方式，是由于因排污行为而获益的不法行为人相对于受到污染损害的被侵权人而言在经济、技术和专业方面占据更大的优势，因而更应当就其排污行为与被侵权人受到的损害后果之间是否具有因果关系承担举证责任。
